RECR

AFFAIRS OF CHINA.

CONFIDENTIAL.

[May 26.]

SECTION 5.

[19297]

No. 1.

Sir,

Foreign Office to Board of Trade.

Foreign Office, May 26, 1911. I TRANSMIT to you herewith a copy of a letter from a Mr. Law, in which enquiry is made as to the steps which should be taken for the protection of patents in

China.

So far as Secretary Sir E. Grey is aware, no modifications in the situation have occurred since the correspondence which passed with your department in 1909. It will be within the recollection of the Board that, with their concurrence, signified in Board of Trade letter of the 8th July, 1909, the firm of Messrs. Herbert Haddan and Co. were informed, in a letter of which a copy is enclosed for convenience of reference,† how the question of the protection of trade-marks and patents in China stood. Sir E. Grey would therefore propose, with the concurrence of the Board, to address a reply in similar terms to Mr. Law.

A paragraph might perhaps be added to the effect that, with regard to the deposit of trade-marks and patents to which Mr. Law alludes, a notice on the subject will be found on p. 58 of the "Board of Trade Journal" of the 10th January, 1907, and that, though no mention is made therein of the matter of patents, it is possible that similar treatment would be obtainable to that accorded by the Imperial Maritime Customs to trade-marks.

I am, &c.

F. A. CAMPBELL.

* Mr. Law, May 17, 1911 [19297]. † To Messrs. Haddan, July 12, 1909 [25875]. [2023 cc-5]
